All operations involving the transmission of personal or banking data are carried out using a secure environment. www.luisolivan.es uses a server based on standard SSL (Secure Socked Layer) security technology. All information you transmit to us travels encrypted over the network.

Credit card fraud is a criminal offence, and www.luisolivan.es will take legal action against anyone who makes a fraudulent transaction in our online shop.

At www.luisolivan.es we are adapted to PSD2, which is the new European directive regulating the provision of electronic payment services and payment transactions. It was transposed into Spanish law by Royal Decree Law 19/2018. At www.luisolivan.es affects purchases paid for by bank card.

Among the main objectives of PSD2 are the improvement of online security and the reinforcement of fraud protection in internet banking.

Among the main security measures is the mandatory application of Strong Customer Authentication (SCA) for all e-commerce purchases from 1 January 2021, unless one of the exemptions provided for in the regulation applies. This strong authentication requires a choice of 2 factors: one that the user knows (e.g. password), one that he/she possesses (e.g. mobile phone) and one that he/she is (e.g. fingerprint or face). The first one will no longer be enough as before, but 2 will be necessary (double authentication or SCA).

The secure purchase process will depend on the issuing bank, and may consist of the code you receive by SMS + a second factor, or validation through your bank's App. Please check with your bank to be prepared before making your next purchases.

All our products are priced in Euros and include VAT and all other excise taxes.

IMPORTANT: www.luisolivan.es does not ship to the Canary Islands, Ceuta or Melilla.

www.luisolivan.es reserves the right to change its prices at any time, but products will be invoiced at the price in effect at the time the order is registered.

SHIPPING METHODS AND DELIVERY TIMES

Orders are processed on the first working day following the day on which they are placed. Delivery times are calculated in working days and may be altered by local or national holidays.

Please note that if the chosen payment method is bank transfer, the order will not be dispatched until we have received confirmation from the bank that the transfer has been received.

www.luisolivan.es/ reserves the right to vary the type of shipment and the carrier by which the shipment is made, regardless of the provisions of these conditions, provided that this does not entail any manifest prejudice to the customer.

Delivery times may be extended in exceptional cases, such as a shortage of material, a high volume of orders, or delays caused by local or national public holidays.

RETURNS AND EXCHANGES

LUIS OLIVAN orders are prepared specifically for each customer. Orders begin to be processed every day at 7 a.m. in the morning. A final confirmation step is always included in each order so that you can be sure that the order placed is correct in terms of units and prices and thus avoid subsequent product returns. We also send you a confirmation e-mail, so that you can check your order.

14-DAY RIGHT OF RETURN

You have fourteen (14) calendar days to return a product with which you are not satisfied. This period starts from the date of delivery of the order. Within this period, you may return the product to us (shipping costs will be borne by you) together with proof of purchase or invoice.

Withdrawal does not require an indication of the reason.

We advise you to protect your item(s), as you will be responsible for any damage suffered during transport. We therefore suggest that you return the goods to us by registered post or carrier and insured for the value of the product. This insurance will be very useful in case of damage or loss of the goods by the transport company. In any case, any costs of returning the goods will be borne by the consumer.

Please avoid any damage, deterioration or soiling of the goods. Please return the goods in their original packaging, complete and with all accessories. If you no longer have the original packaging, please ensure that you return the goods in suitable packaging, so that they are sufficiently protected from damage during transport, in order to avoid possible compensation for damage to the goods resulting from inadequate packaging.

RETURNS

Can I return or exchange a product if I am not satisfied?

If you wish to return an item, we recommend the following procedure for quicker processing:

- Please send us the following form (model B of the Annex to Law 43/2014) indicating the order number and the items you wish to return. If you wish, you can also give us the same information by phone at 974245671

- Then please return the goods in their original packaging, complete and with all accessories. If you no longer have the original packaging, please ensure that you return the goods in suitable packaging so that they are sufficiently protected from damage during transport, in order to avoid possible compensation for damage to the goods resulting from inadequate packaging.

- For shipping you can use any courier agency. Shipping costs will be borne by the customer, which is why we recommend that you send it to us by Correos Certificado as it is a safe and economical way to send it.

ANNEX - Information on the exercise of the right of withdrawal

A. Model consumer and user information document on withdrawal

Right of withdrawal:

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period shall expire 14 calendar days after the day (1).

To exercise the right of withdrawal, you must notify us (2) of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the model withdrawal form below, but its use is not compulsory (3).

In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

Consequences of withdrawal:

In the event of withdrawal by you, we will refund to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the reimbursement (4).

Instructions for completion:

(1) Insert one of the expressions in inverted commas below:

(a) in the case of a service contract or a contract for the supply of water, gas or electricity, where they are not put up for sale in a limited volume or set quantity, of district heating or of digital content which is not supplied on a tangible medium: 'of the conclusion of the contract';

(b) in the case of a contract of sale: 'that you or a third party, other than the carrier and indicated by you, acquired the material possession of the goods';

(c) in the case of a contract for the delivery of multiple goods ordered by the consumer and user in the same order and delivered separately: 'that you or a third party other than the carrier and indicated by you acquired the material possession of the last of those goods';

(d) in case of delivery of a good composed of multiple components or parts: "that you or a third party other than the carrier and indicated by you acquired the material possession of the last component or part";

(e) in the case of a contract for the periodic delivery of goods during a specified period: 'that you or a third party, other than the carrier and indicated by you, acquired the material possession of the first of those goods'.

(2) Insert your name, your full address and, if available, your telephone number, fax number and e-mail address.

(3) If you offer the option on your website to the consumer and user to electronically fill in and submit information regarding his withdrawal from the contract, insert the following text: 'You also have the option to electronically fill in and submit the model withdrawal form or any other unequivocal statement via our website [insert e-mail address]. If you make use of this option, we will inform you without delay in a durable medium (e.g. by e-mail) of the receipt of such withdrawal".

(4) In case of a contract of sale where you have not offered to take back the goods in case of withdrawal, insert the following information:

"We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first".

(5) If the consumer and user has received goods which are the subject matter of the contract insert the following text:

(a) insert:

- We will pick up the goods", or

- You must return or hand over the goods directly to us or to...

(insert the name and address, if any, of the person authorised by you to receive the goods), without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the end of this period;

(b) insert:

- We will bear the costs of returning the goods";

- You shall bear the direct cost of returning the goods";

- If, in a distance contract, you do not offer to bear the cost of returning the goods and the goods, by their nature, cannot normally be returned by post: "You will have to bear the direct cost of returning the goods, ... euro (insert amount)"; or, if a reasonable estimate of the cost of returning the goods cannot be made in advance: "You will have to bear the direct cost of returning the goods. This cost is estimated to be approximately ... euro (insert amount) at the latest"; or

- If, in an off-premises contract, the goods, by their nature, cannot normally be returned by post and have already been delivered to the consumer and user's home at the time of conclusion of the contract: "We will collect the goods at our expense";

(c) "You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods".

(6) In the case of a contract for the provision of services or for the supply of water, gas or electricity - where not packaged for sale in a limited volume or set quantity - or district heating, insert the following: "If you have requested that the provision of services or the supply of water/gas/electricity/commuter heating (delete as appropriate) should commence during the withdrawal period, you shall pay us an amount proportional to the part of the service already provided at the time you have informed us of your withdrawal, in relation to the total subject matter of the contract."

IN CASE OF REIMBURSEMENT:

If the product is returned within fourteen days of delivery to your home, LUIS OLIVAN will reimburse you by the same method used by you to make the payment. If this method of reimbursement is not feasible, LUIS OLIVAN will reimburse you by bank transfer. In the event of a technical analysis of the product in the context of the right of withdrawal, LUIS OLIVAN will make every effort to reimburse the user as soon as possible.

MODIFICATIONS

After placing your order you will receive a confirmation email. Please note that once the order is confirmed, the products are manufactured, packed and shipped the next day. It is therefore advisable to check the order and make sure that all the details are correct. To make changes to an order placed, please contact us by telephone as soon as possible between the hours of 7am and 3pm. In case of modification, www.luisolivan.es reserves the right to ship the product at a later date than originally estimated.

The purchase of certain items is subject to special conditions (restrictions on the sale of alcoholic beverages, pre-sales...). The sale of alcoholic beverages to persons under 18 years of age is not permitted.

Our online shop offers a selection of wines, which are subject to special taxes and are only shipped to Spain (Peninsula and Balearic Islands). We regret that we are unable to ship internationally due to the complexity of the regulations and taxation of our articles, as they are not exportable in some countries. It is also advisable to consult the restrictions of the destination country for certain types of merchandise.

The products offered in this service are aimed at end consumers under the terms and conditions set out in the Retail Trade Act. In this sense, any purchase request, outside the parameters of an average consumer and/or mass requests for orders from the same buyer and/or recipient may not be met.
